Would a site enabling peer-to-peer lending/borrowing count as a money transmitter legally?

From the looks of it (Point #1 & #2), it seems that is just referral fees / commission, so no money transmitter issue there.

Point # 3 however, does raise an eye-brow (meaning that's a pretty grey area).
