Is FinCEN MSB registration the same as a money transmitter license?

FinCEN registration and state money transmitter licensing serve different purposes. You need to understand both before deciding that your business is ready to operate.

FinCEN registers money services businesses under the federal anti-money-laundering framework. A registration number does not mean that FinCEN has approved your business model or licensed you to transmit money throughout the United States. FinCEN expressly warns against presenting registration as a license or government endorsement. FinCEN guidance

State licensing is a separate analysis. We have to look at what your company does, where its customers are, how the funds move, and whether a particular exemption or properly structured agency arrangement applies.

Montana is a common source of confusion. Its banking regulator says that Montana does not regulate money transmitters. That does not create a “Montana money transmitter license,” and incorporating there does not give you permission to serve customers in every other state. Montana regulator

My suggestion is to be precise when speaking to banks, partners, and investors. If you are FinCEN-registered, say that. If you hold state licenses, identify them. If you operate through a licensed principal, explain that relationship accurately.

Before spending money on a structure, document the actual service and transaction flow. Then establish which registrations, licenses, or exemptions support that particular operation. A registration certificate by itself is an incomplete answer.
